The Government and National Assembly must take in the recommendations of the National Human Rights Commission, and pass the revised bill on the prevention of AIDS


On February 26th, the National Human Rights Commission announced its recommendation on the AIDS prevention measures of the government and conveyed it to the Ministry of Welfare and Health. In its recommendation, the National Human Rights Commission stated that prevention of AIDS cannot be achieved through observation and quarantine, and can only be accomplished through the efforts of the state to promote the rights of PLHA persons, the voluntary cooperation of PLHA and the right understanding by the general public. The Joint Action Committee(?) welcomes the statement(opinion) of the National Human Rights Commission, and at the same time urge the government and the National Assembly to actively accommodate the recommendation.

The AIDS preventive measures which can be said to be the basis of the government's AIDS policy, has been revised several times. However the infection rate of Korea has not decreased at all, and in actual fact, the polices are setting back the voluntary prevention efforts of PLHA and non-infected.

The "Obligation to restrict spread of infection" clause(PLHA will be prosecuted if they have sexual contact with the non-infected without announcing the fact ''he/she is HIV positive' to the partner or using condom) which is beyond comparison to other provisions of its kind, is not only unsupportive, but also deepens the prejudice against PLHA. Together with mandatory medical tests, it is one of the policies on the top of the list of policies that should be avoided, selected by related international organizations. The recommendation of the National Human Rights Commission clearly points this out and recommends the removal of the above clauses.

Assurance of anonymity is part of the foundation for the protection of human rights of PLHA. Therefore, it is difficult to secure voluntary tests or effective human rights protection without taking measures for not only anonymous testing but also anonymity management and report. In addition, all HIV tests which is not voluntarily, should be carried out with the clear preliminary consent on paper by the tested. Moreover, under the current practice of informing the employer of the results of the medical examination at the workplace, taking measures to ensure that only the tested receives the results of the HIV test, is an essential step in the protection of the right to work of PLHA. The commission has also urged for substantial measures on this matter as well.

Together with such matters, the commission has also identified the need for the right to access medical treatment for migrant workers which corresponds to the same standards that apply to domestic residents, and emphasized the need of human rights education for medical service staff and staff at public health centers for effective prevention.

On top of all these, we also state the importance of preliminary and follow-up counseling for PLHA and the obligation of the state to take all necessary measures for the treatment of PLHA. Needless to say, not only PLHA but the public in general should have access to accurate information, the best treatment available, and the means to substantive and emotional support.

The promotion of the human rights of PLHA is not an exclusive matter unrelated to the prevention of AIDS, but rather a most effective means of prevention. Furthermore, this is an important issue, where the level of the human rights of the HIV/AIDS infected, who are one of the most fragile groups in society, serves as an index to measure the human rights level of our society. In spite of this, the government has failed to recognize that the promotion of the human rights of PLHA is at the core of the AIDS policy, and even though a completely revised bill in place of the existing prevention law has been submitted, the National Assembly has not even proposed the bill.

We strongly demand that the government and the national assembly take in the recommendations of the National Human Rights Commission, and from now onwards make all efforts for the health and human rights protection of the general public. The national assembly should not delay the general revision of the law of HIV/AIDS Prevention and the government should immediately make systematic reforms for the promotion of the human rights.
